I have three aims in this essay. I want to offer an example of an interdisciplinary historical inquiry combining literary criticism with the relatively new field of critical legal studies. I intend to use this historical inquiry to argue that the ambiguity of literary texts might better be understood in terms of an era’s social contradictions rather than in terms of the inherent qualities of literary language or rhetoric and, conversely, that a text’s ambiguity can help us expose the contradictions (...) masked by an era’s dominant ideology. I try to prove my assertion by applying my method to Herman Melville’s three most famous short works—“Benito Cereno,” “Bartleby, the Scrivener,” and Bill Budd, Sailor—works dealing with the law and lawyers and widely acknowledged as ambiguous.1 I will base my critical inquiry into these stories on Melville’s relationship with his father-in-law, Lemuel Shaw, who, while sitting as the chief justice of the Supreme Judicial Court of Massachusetts from 1830 to 1860, wrote some of the most important opinions in what Roscoe Pound has called “the formative era of American law.”2Before I get started, I should clarify what this study does not entail. By using Shaw and his legal decisions in conjunction with Melville’s fiction, I am not conducting a positivistic influence study. My method will not depend on the positivist assumption that Shaw’s legal opinions can be used to illuminate Melville’s texts only when his direct knowledge of Shaw’s opinions can be proved. Nor will I limit myself to a traditional psychoanalytic reading: my emphasis is on political and social issues, and too often these issues are deflected by translating them into psychological ones. At the same time, I recognize that critics concerned with political and social issues too often neglect questions raised by a writer’s individual situation. I compare Shaw to Melville not to reduce Melville’s politics to psychology but to prevent a political study from neglecting the political implications of psychology, to remind us—as the title of Fredric Jameson’s book The Political Unconscious reminds us—that psychological questions always have political implications. 1. In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. John Rist surveys the history of ethics from Plato to the present and offers a vigorous defence of an ethical theory based on a revised version of Platonic realism. In a wide-ranging discussion he examines well-known alternatives to Platonism, in particular Epicurus, Hobbes, Hume and Kant as well as contemporary 'practical reasoners', and argues that most post-Enlightenment theories of morality (as well as Nietzschean subversions of such theories) depend on an abandoned Christian metaphysic and are unintelligible without such grounding. This question invites reflection upon the rhetoric of “sacrifice,” especially as often deployed within wealthy consumer societies. This rhetoric has become a political sticking point that often entangles environmental discourse in a false dichotomy between sacrifice and self-interest and thereby constrains the political imaginary. By challenging this dichotomy we can draw attention to the ubiquity of notions of sacrifice (...) in everyday life, thereby defusing its ability to shut down ambitious proposals for action. In this book, John M. Rist offers an account of the concept of 'person' as it has developed in the West, and how it has become alien in a post-Christian culture. He begins by identifying the 'mainline tradition' about persons as it evolved from the time of Plato to the High Middle Ages, then turns to successive attacks on it in the seventeenth and eighteenth centuries, then proceeds to the 'five ways' in which the tradition was savaged or distorted (...) in the nineteenth century and beyond. He concludes by considering whether ideas from contemporary philosophical movements, those that combine a closer analysis of human nature with a more traditional metaphysical background, may enable the tradition to be restored. Scientists and 'anti-scientists' alike need a more realistic image of science. The traditional mode of research, academic science, is not just a 'method': it is a distinctive culture, whose members win esteem and employment by making public their findings. Fierce competition for credibility is strictly regulated by established practices such as peer review. Highly specialized international communities of independent experts form spontaneously and generate the type of knowledge we call 'scientific' - systematic, theoretical, empirically-tested, quantitative, and so on. John Doris draws on behavioral science, especially social psychology, to argue that we misattribute the causes of behavior to personality traits and other fixed aspects of character rather than to the situational context. Literature on the Stoa usually concentrates on historical accounts of the development of the school and on Stoicism as a social movement. In this 1977 text, Professor Rist's approach is to examine in detail a series of philosophical problems discussed by leading members of the Stoic school. He is not concerned with social history or with the influence of Stoicism on popular beliefs in the Ancient world, but with such questions as the relation between Stoicism and the thought of Aristotle, (...) the meaning and purpose of such Stoic paradoxes as 'all sins are equal', and the philosophical interrelation of Stoic physics and ethics. The Moral Psychology Handbook offers a survey of contemporary moral psychology, integrating evidence and argument from philosophy and the human sciences.

This major work constitutes a significant attempt to provide a detailed and accurate account of the character and effects of Augustine's thought as a whole. It describes the transformation of Greco-Roman philosophy into the version that was to become the most influential in the history of Western thought. Augustine weighed some of the major themes of classical philosophy and ancient culture against the truth he found in the Bible and Catholic tradition, and reformulated these in Christian dress.

In three experiments we studied lay observers’ attributions of responsibility for an antisocial act (homicide). We systematically varied both the degree to which the action was coerced by external circumstances and the degree to which the actor endorsed and accepted ownership of the act, a psychological state that philosophers have termed ‘identification’. Our findings with respect to identification were highly consistent. The more an actor was identified with an action, the more likely observers were to assign responsibility to the actor, (...) even when the action was performed under constraints so powerful that no other behavioral option was available. Our findings indicate that social cognition involving assignment of responsibility for an action is a more complex process than previous research has indicated. It would appear that laypersons’ judgments of moral responsibility may, in some circumstances, accord with philosophical views in which freedom and determinism are regarded to be compatible. (shrink)
